Terms of Service

These Terms of Service ("Terms") govern your use of PrismCV ("Service"), operated by PrismCV ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using PrismCV, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

PrismCV provides resume building, job tracking, ATS compatibility analysis, and career management tools. Some features use artificial intelligence (powered by Anthropic's Claude) to generate content suggestions, analyze resumes, and create cover letters.

3. Account Registration

  • You must provide accurate and complete information when creating an account.

  • You are responsible for maintaining the security of your account credentials.

  • You must be at least 16 years old to use the Service.

  • You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.

  • Upload malicious files, viruses, or content designed to disrupt the Service.

  • Attempt to gain unauthorized access to other users' accounts or data.

  • Use automated tools (bots, scrapers) to access the Service without permission.

  • Resell, redistribute, or sublicense the Service without written consent.

  • Submit false, misleading, or fraudulent information in resumes or applications.

5. Subscription & Payments

PrismCV offers free and paid subscription tiers. Paid subscriptions are billed through Stripe. By subscribing to a paid plan, you agree to pay the applicable fees.

  • Subscriptions renew automatically unless cancelled before the renewal date.

  • You may cancel your subscription at any time. Access continues until the end of the current billing period.

  • Refunds are handled on a case-by-case basis. Contact support for refund requests.

  • We reserve the right to change pricing with 30 days' notice to existing subscribers.

6. Intellectual Property

Your Content: You retain ownership of all content you create or upload to PrismCV, including resumes, cover letters, and application data. By using the Service, you grant us a limited license to process your content solely to provide the Service.

Our Service:PrismCV's software, design, branding, and documentation are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our Service without permission.

AI-Generated Content: Content generated by AI features (resume tailoring, cover letters) is provided as suggestions. You are responsible for reviewing and editing AI-generated content before use.

7. Data & Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to the data practices described in the Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied.

  • We do not guarantee that AI-generated content will be accurate, complete, or suitable for any particular purpose.

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

10. Termination

  • You may delete your account at any time through Settings. All your data will be permanently deleted upon account deletion.

  • We may suspend or terminate your account if you violate these Terms, with notice when feasible.

  • Upon termination, your right to use the Service ceases immediately. You may export your data before deletion.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice for planned maintenance when possible.

12. Dispute Resolution

These Terms are governed by the laws of the State of California, United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in San Diego, California, under the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
